Abstract
The European Commission introduces rules on simplified winding-up proceedings for insolvent microenterprises in the Proposal for a directive on harmonising certain aspects of insolvency law. When comparing these proposed proceedings with Dutch law, one notices that it is something in-between already existing proceedings in both company law and insolvency law. In this Article, the proposed EU proceedings are compared with the already existing Dutch ones. This article will be concluded by a critical note regarding the Proposal of the European Commission.
