Abstract

The Grand Chamber ruling annotated here deals with the balance between Union citizens’ right to move and the power of Member States to control who resides within their territory, in an area without border checks.1 Unlike most rulings on expulsions, this one concerns the termination – pursuant to Article 15 Directive 2004/382 – of the illegal residence of a Union citizen in a host State3when they failed to comply with the conditions to reside under Directive 2004/38: what Kramer called “expulsion on grounds of poverty”.4
