Abstract

2006 was probably not the most exciting period for tort law in the netherlands. The most noteworthy developments are: the presentation of a code for dealing with personal injury cases1; the entry into force of title 7.17 of the dutch civil code, introducing a new insurance law; the fact that the hoge raad has accepted proportional liability. The latter issue is of course the most important one from the perspective of tort law and will be discussed in further detail below.
