Abstract

The regulation of transport represents a remarkably interesting and complex policy field where the influence of international technical standards on the European Union (EU) legal system is particularly important. The chapter aims to explore the role of international standardisation in the EU transport policy. It will first present the various global regulators in the different fields of transport. Second, it will examine the incorporation of global standards in EU legislation, as well as the different methods of incorporation. Third, it will analyse the case study of the technical standards developed by the International Civil Aviation Organization and the incorporation of the Carbon Offsetting and Reduction Scheme for International Aviation in EU law. Finally, the chapter will draw some conclusions on the phenomenon of incorporating global standards in the EU legal system, reflecting on its impact on the EU principles of good governance, such as participation and transparency.
