The influence of the four (or five) Freedoms on Property law

Abstract

In the European Union there is a single market that is governed by EU internal market law. Internal market law also concerns property law and each of the five freedoms (goods, persons, services, capital and data) have effect on national rules of property law. Cross border trade puts pressure on national systems of property law, especially where there are divergences between national legal systems; perhaps best visible in the different lists of available property rights (numerus clausus). Internal market law has the potential to force a different application of national rules, both in private international law (lex rei sitae) as well as in substantive national property law (such as the numerus clausus).
