Abstract
The ‘Kelderluikcriteria’ (criteria for assessing negligence, dangerous situations in particular) are familiar to many Dutch legal scholars, but can they be identified in case law? This question matters for several purposes, including determining when specific factors are applied, improving retrieval of judgments involving the Kelderluikcriteria and assessing whether judges apply them consistently. Before such analyses can be conducted, it must be established whether the factors can be identified reliably. This article examines this question using an empirical method: measuring agreement between independent annotators who identify and label the Kelderluikcriteria in case law. The results suggest that acceptable agreement can be achieved for most.
