Abstract

This book examines civil procedure rules from a comparative perspective - that is, the rules that dictate how a civil dispute is initiated, processed, decided and enforced in a court of law. Where the administration of justice is often less a matter of deciphering an objective truth than a decision made on legal facts, determining who, what, where and how these legal facts are fashioned from a messy dispute is the crux of civil procedure. In examining civil procedure comparatively, this book fills the gap related to our understanding of the process of resolving civil disputes, disputes constituting a large part of claims heard by courts around the world.
