Abstract
The Court of Justice of the European Union (CJEU) is increasingly acting as a guardian of democracy in EU member states. While traditionally focused on the rule of law, the CJEU recently addressed national laws restricting political party membership. In cases against Poland and the Czech Republic, the Court ruled that limiting party membership to nationals violates EU citizens' passive electoral rights, as political parties are essential to representative democracy. These rulings may impact the Dutch political system, where parties are minimally regulated. Therefore, the Dutch legislature should anticipate further EU legal requirements to protect democratic processes.
