Abstract

This article explores the transformative paradigm of human rights. It presents a series of structural features that define this paradigm including the unrestricted reception of positive rights; an expansive catalog of rights; the mobilization of human rights against the root causes of social ills; the proliferation of rights conflicts; and the universalization of balancing as a tool for making legal decisions. The article then explains that these traits produce internal contradictions within the transformative paradigm, frustrating the achievement of equality, the empowerment of right-holders, and the rule of law.
