Abstract

The resolution of conflicts of human rights has traditionally focused on comparing the weight of the rights in conflict and other “objective” features of the situation. The present article explains that this focus is too narrow, and recommends also considering the subjective desert of the parties in light of an overarching demand to reasonably accommodate the rights of others. This, it is claimed can improve the reliability and accuracy of decision-making in conflict cases.
