Abstract
O mundo é, cada vez mais, uma aldeia global em que crescem e se entrecruzam as relações entre Estados e entre os indivíduos e Estados diferentes do Estado da sua nacionalidade. Por conseguinte, o instituto basilar da responsabilidade internacional dos Estados assume particular importância e, apesar das suas significativas semelhanças com a responsabilidade civil da ordem interna, revela-se especialmente pertinente debater sobre a sua efetivação, que enfrenta ainda múltiplos obstáculos associados à soberania estadual. Abraçando esta temática, o presente estudo parte de uma exposição comparativa entre responsabilidade civil no plano interno e responsabilidade internacional dos Estados (os seus pressupostos e consequências jurídicas), seguindo-se uma análise de casos particularmente relevantes relativos à responsabilidade dos Estados em face de outros Estados e de cidadãos de outros Estados e, por fim, uma reflexão atinente às debilidades apontadas à efetivação da responsabilidade internacional dos Estados acompanhada da apresentação de algumas propostas para a colmatação das lacunas ainda existentes no direito da responsabilidade internacional dos Estados.
The world is increasingly becoming a global village in which relations between States and between individuals and States other than the State of their nationality grow and intertwine. Therefore, the fundamental institute of State responsibility for internationally wrongful acts assumes particular importance and, despite its significant similarities with civil responsibility, it is especially appropriate to discuss its implementation, which still faces multiple obstacles associated with State sovereignty. Embracing this theme, this study begins with a comparative exposition of civil responsibility at domestic level and the international responsibility of States (its prerequisites and legal consequences), followed by an analysis of particularly relevant cases concerning the responsibility of States vis-à-vis other States and citizens of other States and, finally, a reflection on the frailties pointed out to the implementation of State responsibility, accompanied by the presentation of some proposals to fill the gaps that still exist in the law of the international responsibility of States.
