FullCompensation - Rationalising Full Compensation of Non-Pecuniary Damages to Reconcile Equal Treatment and Personalisation

    Description

    FullCompensation is a project that has received funding from the European Union''s Horizon 2020 research and innovation programme under the Marie Sklodowska-Curie grant agreement No 101028723. This project studies the full compensation of non-pecuniary damages in the EU from a comparative-empirical perspective. Non-pecuniary damages are non-economic losses that cannot be measured accurately in money. There is a concern in the literature that the awarding of such damages is fragmented and surrounded by bias. The project aims to develop evidence-based guidelines for adjudicators and a model legislative proposal for the EU Member States to award non pecuniary damages in a way that reconciles equal treatment and personalisation. To this end, the guidelines already used in the EU Member States to award non-pecuniary damages are comparatively reviewed. Further, empirical evidence is also gathered by analysing the case-law of selected national jurisdictions, interviewing adjudicators, and conducting stakeholder focus groups. This dataset contains the protocols of the empirical activities involved in the project.
