Diversity can be expressed in the fact that a social group creates its own law. In the 19th and also in the 20th centuries there was a lot of discussion about commercial law as the law of a particular group. In some cases, the lines of connection were drawn to the "autonomous" pre-modern law of merchants. To what extent can commercial law really be understood as the self-established law of a social group, which thereby realizes its own normative beliefs? The paper aims to trace the development of the relationship between state-legal ideas of design and ideas of autonomy in commerce.
