The debate on the impact of Artificial Intelligence on fundamental rights is gradually gaining attention in the academic discussion. At the forefront are questions on the impact of algorithms on fundamental rights, in particular on the prohibition of discrimination, right to privacy and freedom of expression. Other questions such as algorithms’ impact on human dignity, right to the integrity or prohibition of inhuman or degrading treatment have thus far received less attention. The presentation aims to fill this gap and analyse the threats to the human rights derived from dignity in the setting of Artificial Intelligence. Questions such as ‘Does elderly care with intelligent robots impinge upon the human dignity of the elderly?’ and ‘Is an intelligent police robot allowed to kill a human suspect out of self-defence?’ will be put to the discussion. The presentation will elaborate on how AI can impact theoretical conceptions of fundamental rights and conclude with thoughts on why AI agents should not benefit from any type of fundamental rights protection.
